PRIVACY STATEMENT

DIGIWEDO is aanbieder van de DMI-ecosysteem website en het geïntegreerde community platform. In dit document hebben we onze privacyverklaring beschreven. De klant in deze is zowel het Ministerie van IenW alsmede andere partijen die (tegen betaling) gebruik maken van het platform. Als we in het vervolg over de Klant spreken betreft het alle betalende partijen.

1. Our commitment to privacy

Uw privacy is belangrijk voor ons bij DIGIWEDO en voor de Klant en daarom willen we u informeren. Om u meer transparante en duidelijke informatie te geven over hoe wij uw persoonlijke gegevens verwerken vertellen wij u in deze Privacyverklaring hoe wij met uw gegevens omgaan en welke keuzes u kunt maken over de wijze waarop wij uw gegevens verwerken. Om deze privacyverklaring toegankelijk te maken, zorgen wij ervoor dat deze beschikbaar is op onze website en op elk punt waar persoonsgegevens worden gevraagd.

Voordat u van onze diensten gebruik maakt, raden wij u aan deze privacyverklaring te lezen en er zeker van te zijn dat u alles heeft begrepen over hoe en op welke wijze wij met uw gegevens omgaan. Indien u deze privacyverklaring heeft gelezen en het niet eens bent met onze werkwijze, verlaat u dan onze applicatie en vermijdt of beëindigt u al het gebruik van onze diensten.

In addition, we explain how we use and possibly share this personal data and what rights you have. This Privacy Statement is not intended to override any other terms of any agreement you may have with us, nor to limit any other legal right.
• De bescherming van jongeren is met name zeer belangrijk. In de Algemene verordening gegevensbescherming (AVG) is in artikel 8 opgenomen dat vanaf 16 jaar jongeren zelf toestemming moeten geven voor de verwerking van hun persoonsgegevens. Tot 16 jaar kan een persoon dus niet zelf toestemming geven, maar zal zijn/haar wettelijk vertegenwoordiger dit moeten doen. Daarvoor zullen wij nooit informatie verzamelen of gebruiken van personen van wie wij weten dat ze onder 16 jaar zijn. Ouder(s) en voogd(en) moeten te allen tijde toezicht houden op de activiteiten van hun kinderen. Mochten wij erachter komen dat wij persoonsgegevens hebben verzameld of gekregen van personen onder de 16 zonder ouderlijke toestemming, dan zullen we deze gegevens onmiddellijk verwijderen. Denkt u dat wij misschien enige gegevens hebben van een persoon onder de 16 jaar, neemt u dan alstublieft contact met ons op.

• Our website uses necessary cookies. Necessary cookies are essential and help you navigate the website.  3. Welke informatie verzamelen wij en hoe verzamelen wij deze informatie?

• Personal data is collected when you voluntarily provide it when you register with or use our services. This data is necessary for the performance of the service we provide to you, such as access to the DMI ecosystem community, the DMI News Releases and invitations to events.
• If you interact with us through social media, e.g. Facebook or LinkedIn, we collect login information and the personal data you voluntarily provide, such as posts you make to our social media pages. If you upload content, including personal data, to a social network and then add our website, your action will become part of that social network's terms and conditions of use and privacy policy, even if you post it on an official Ministry of IenW page of that social network. We do not control and have not reviewed those terms and conditions of use and privacy policies. Therefore, you will need to review those terms and conditions before leaving your personal information there.

4. How do we use your personal data?

We use your data for internal use:

• To improve our services to better meet customer needs and to gain insight into possible improvement(s);
• To manage your request online, by processing your orders through our online services;
• To monitor the use of our application/website;
• To improve the functionality of our application/website.
  • To communicate with you.
  • In extreme cases, we may use your personal data to enforce our rights against third parties and to protect our interests.

5. Legal basis for processing personal data

We collect, use and share your personal information for the purposes identified in this privacy statement only if we are satisfied that:

• our use of your personal information is necessary for the formation or performance of a contract with you;
• the processing of your personal data, in order to improve our services, is based on our legitimate interest. In doing so, we will use this data proportionally and respect your privacy rights;
• our use of your personal data is necessary to enforce a legal claim or otherwise required to enforce a law or regulation;
• You have given your consent to the use for a specific purpose named by you.

6. Who is the controller for processing your personal data?

DIGIWEDO als beheerder van het platform is verwerkingsverantwoordelijke voor de diensten die wij aanbieden. Op basis van de wet is de Klant in veel gevallen niet verantwoordelijk voor het verwerken van uw persoonsgegevens. Wij zijn dan verwerker. Een andere organisatie, is dan op basis van de wet verantwoordelijk.

Wanneer u contact op wilt nemen of gebruik wil maken van uw gebruikers- of klantrecht(en) dan kunt u zich wenden tot de verwerkingsverantwoordelijke.

7. Who has access to your personal data?

• De Klant: binnen de Klant hebben de medewerkers die werken aan de totstandkoming van het  DMI-ecosysteem toegang tot uw persoonsgegevens.
• De Klant en derden: we zullen uw gegevens nooit doorsturen, verkopen aan of ruilen met derden (niet zijnde de directe Klant)  voor marketingdoeleinden. Gegevens die worden doorgestuurd aan derden, worden alleen gebruikt om u te voorzien van onze diensten en dus met organisaties of leveranciers die door ons zijn ingeschakeld om u assistentie te verlenen. DIGIWEDO of de Klant heeft met de betreffende organisaties of leveranciers afspraken gemaakt om te zorgen dat zij passende organisatorische en technische maatregelen nemen om te kunnen verzekeren dat uw privacy gewaarborgd is. Houd er rekening mee dat veel van deze ontvangende derden een zelfstandig recht of zelfstandige verplichting hebben om uw persoonsgegevens te verwerken.

8. How do we protect your data and where do we store your data?

• We process your personal data only within the EU. Our servers and backups are located in Germany.
• The data we collect from you is also stored within the DMI ecosystem CRM (client Ministry of IenW), but may also be transferred to third parties should it be necessary for the proper functioning of the DMI ecosystem platform or related services. Any such transfer of your personal data will be carried out in accordance with applicable laws and never without your consent.
• Gegevensbescherming: Zowel DIGIWEDO alsook Klant begrijpt en onderschrijft het belang van uw persoonlijke informatie en zorgt voor adequate administratieve, technische en fysieke beschermingsmiddelen ter bescherming van uw persoonsgegevens. Zoals bijvoorbeeld een training privacy bewustzijn voor onze medewerkers. Deze middelen zijn ontworpen om de vertrouwelijkheid van uw persoonsgegevens te handhaven en om deze te beschermen voor ongeautoriseerde toegang, misbruik en verlies. U bent zich er echter van bewust en stemt in dat: (i) in het algemeen, de overdracht van informatie over het internet nooit volledig veilig, privé of vertrouwelijk is; en (ii) alle informatie die gestuurd wordt naar of ontvangen wordt door de website onderschept, ontcijferd, geraadpleegd en gebruikt kan worden door derde partijen, zelfs als de uitwisseling van zulke informatie versleuteld is.
• Bewaartermijn:  wij kunnen uw persoonsgegevens zolang als nodig bewaren, indien deze nodig is voor het leveren van onze diensten. Na die tijd, zolang dat wettelijk is toegestaan en gebaseerd op wettelijke verplichtingen of gerechtvaardigde belangen.

9. Use of cookies

• DIGIWEDO maakt slechts gebruik van noodzakelijke en functionele cookies. Onze website gebruikt twee hoofd functionele cookies. Deze cookies geven de website de mogelijkheid uw voorkeurstaal te onthouden en of u de algemene voorwaarden en deze privacyverklaring heeft geaccepteerd. DIGIWEDO verwerkt deze cookies intern.
• Please note that third parties may place cookies or use other tracking technologies through our services and may have their own policies on how they collect and store information. These uses are not covered by our privacy statement and we have no control over them.
• Once you have given your consent to the use of cookies, we will place a cookie on your computer or other device to remember this for next time. To do so, you can block cookies by activating the setting on your browser that allows you to reuse the setting of all or some cookies. However, if you set your browser settings to block all cookies, you may not be able to access all or parts of the website because some cookies may be functional cookies.

10. Your rights regarding your personal data

10.1 Your rights

• Right of access: You have the right to request information about the personal data we hold about you at any time
• Right to portability: Where the Ministry of IenW processes your personal data by automated means based on your consent or pursuant to an agreement, you have the right to obtain a copy of your data in a structured, commonly used and machine-readable format, transferred to you or another party. This applies only to the personal data you have provided to us.
• Right to correct: You have the right to request correction of your personal data when it is incorrect, including the right to complete incomplete personal data.
• Right to delete: You have the right to delete personal data processed by the Ministry of IenW at any time, except in the following situations:
  • You have an ongoing case with customer service
• The right to object to processing based on a legitimate interest
• You have the right to object to the processing of your personal data based on a legitimate interest of the Ministry of IenW. The Ministry of IenW will not continue to process personal data unless we can demonstrate a legal basis for the process that outweighs your interests and rights or as a result of legal claims.
• You have the right to object to direct marketing.
• Right to restriction: You have the right to request the Ministry of IenW to restrict the processing of your personal data in the following circumstances:
  • Als u bezwaar maakt tegen een verwerking op basis van een gerechtvaardigd belang van Klant, beperkt DIGIWEDO elke verwerking van dergelijke gegevens in afwachting van de verificatie van het gerechtvaardigd belang.
  • Indien u een claim hebt ingediend dat uw persoonsgegevens incorrect zijn, moet DIGIWEDO elke verwerking van dergelijke gegevens beperken in afwachting van de verificatie van de nauwkeurigheid van de persoonsgegevens.
  • If the processing is unlawful, you may oppose the deletion of your personal data and instead request the restriction of the use of your personal data
  • Als Klant of DIGIWEDO uw persoonsgegevens niet langer nodig heeft, maar de persoonsgegevens voor u nodig zijn om verdedigende juridische claims in te dienen.

10.2 Hoe kunt u uw rechten uitoefenen?
We nemen gegevensbescherming heel serieus. Indien u van mening bent dat het Ministerie van IenW uw persoonsgegevens niet correct verwerkt, kunt u contact met ons opnemen via dmi-team@dmi-ecosysteem.nl. U hebt ook het recht om een klacht in te dienen bij een toezichthoudende autoriteit, wij willen u echter vragen om eerst contact met ons op te nemen. 11. Updates to our privacy statement

On occasion, our privacy statement may need to be updated. The latest version of the privacy statement is always available on our website. We disclose any material changes to the privacy statement, for example, regarding the purpose of using your personal data, the identity of the controller, or your rights.
